联合国人权理事会第63届会议在9月7日至10月7日召开。当地时间9月23日上午,中南大学人权研究中心黎娟副教授作为中国人权研究会代表在关于保护世界文化和自然遗产公约的土著人民权利年度小组讨论中作大会发言。她在发言中介绍了云南景迈山古茶林文化景观成为世界遗产的案例,为协同世界遗产保护、人权保护和可持续发展提供了一个中国答案。现将发言原文及翻译分享如下:

Respectful Chair, the Operational Guidelines for the Implementation of the World Heritage Convention encourage a human rights-based approach. Nevertheless, significant gaps remain in their consistent implementation. The critical question is how to achieve synergy among heritage conservation, indigenous peoples’ rights and development. China’s Jingmai Mountain may offer an answer.
In 2023, the Cultural Landscape of Old Tea Forests of Jingmai Mountain in Yunnan became the world’s first tea-themed World Heritage site. Since then, diverse pathways to sustainable conservation have been explored.
First, institutional building. Local regulations were enacted, defining the scope of protection and responsible entities, providing a legal framework for the site.
Second, shared custodianship. Honoring the Bulang ancestors’ precept to “cherish the tea trees as one’s own eyes” local communities and indigenous peoples serve as the main actors. They have formed tea tree guardianship teams, trained representative inheritors of cultural heritage, and become disseminators of tea culture and beneficiaries of the tea industry, gaining tangible income from protection.
Third, digital empowerment: intelligent monitoring system provides round-the-clock ecological guardianship, giving the millennia-old tea forests enduring vitality.
Jingmai Mountain demonstrates that heritage conservation and sustainable development can advance hand in hand.

《实施〈世界遗产公约〉操作指南》倡导采用基于人权的方法,但在持续、有效落实方面仍存在明显差距。关键问题在于,如何实现遗产保护、土著人民权利与发展的协同推进。中国的景迈山文化景观或许提供了一个答案。
2023年,云南普洱景迈山古茶林文化景观成为全球首个茶主题世界遗产。此后,当地不断探索可持续保护的多元路径。
第一,完善制度建设。当地制定相关法规,明确保护范围和责任主体,为遗产保护提供法律保障。
第二,推动共同守护。秉持布朗族先民“像爱护眼睛一样爱护茶树”的祖训,当地社区和土著人民成为保护的主体。他们组建古茶树守护队伍,培养非遗代表性传承人,既成为茶文化的传播者,也成为茶产业的受益者,从保护中获得切实收益。
第三,数字赋能。智能监测系统对生态环境进行全天候监测,为千年古茶林的持续保护提供科技支撑。
景迈山的实践表明,遗产保护与可持续发展可以相互促进、并行推进。
